On February 18, the Kyiv Court of Appeal ruled in the case of Alyona Shevtsova's lawsuit against the publisher of Mind – Future Media LLC on the protection of honor, dignity, and business reputation and refutation of false information.
It should be reminded, earlier the Podilskyi District Court of Kyiv City partly satisfied the reputational lawsuit against Mind.
The Kyiv Court of Appeal fully satisfied the appeal of the publisher mind.ua Future Media LLC and canceled the decision of the Podilskyi District Court, which partially satisfied Shevtsova's claims against Mind. The Court of Appeal also upheld that part of the decision in the case of the first instance, in which the plaintiff was immediately refused to satisfy part of the claim.
The resolution came into force from the moment of its announcement, from Thursday, February 18, 2021.
It should be reminded, the beneficiary of financial company Leogaming Pay LLC Alyona Shevtsova (Degrik) turned to the publisher of Mind.ua Future Media LLC demanding an official refutation of the news published on the portal. The lawsuit disputes information about the business ties of companies that were associated with Alyona Shevtsova (Degrik) and the Tyme payment system.
The plaintiff assured the court that she is not and was not the head of the legal entity Mossada Investments Limited (formerly Frugifera Investments Limited, number ΗΕ 309657), since she did not sign any documents on the appointment of the director of the said legal entity.
At the time of publication of the material, Mind referred to electronic scanned copies of extracts from the registers. At the time of the hearing in the Court of Appeal, the editorial board was able to obtain the originals of extracts from the register of the Republic of Cyprus.
Although in the documents Alona Degrik is indicated as the head of the company, the place of registration of which is the same as the place of registration of Alyona Shevtsova (maiden name Degrik) in Odessa, Shevtsova's lawyers tried to prove in court that these are different people and Shevtsova is not related to Alyona Degrik (Alona Degrik). The main argument of Shevtsova's representative was that she changed her last name from Degrik to Shevtsova during the wedding in 2016, while the company was registered in 2017 (obviously, according to a passport).
The lawyer also argued that one cannot speak of a connection between people if the companies through which this connection is traced have been liquidated.
Let us remind: the director of the Mossada company, indicated as "Alona Degrik", was changed to the Russian Roman Fomin, and on June 26, 2020, the company is in the phase of termination – to be struck off the company register.
In Ukraine, Mossada is the owner of Telecom Media LLC (37882481), which, according to the State Register of Rights to Real Estate and the Register of Property Rights to Real Estate, during May-August 2015, was a real estate manager at the address: Kyiv, st. Zvirynetska 47-17. At the moment, the owner of this property is a non-resident – the Cyprus company LEO PARTNERS (CY) LIMITED, the title of which was registered in October 2013 based on a donation agreement.
This is the same address at which Leo Partners LLC is registered (36676798), the head of which is Alyona Volodymyrivna Shevtsova (until 2016, the name of Alyona Volodymyrivna Degrik was indicated in the data about the head). The only member of Leo Partners is the already mentioned Cypriot company Leo Partners (CY) Limited (ΗΕ 324078).
The court also upheld the decision of the Podilskyi Court in refusing to refute the thesis that "Elena Shevtsova (Degrik) is generally associated either with the new head of the NBU, Yakov Smoliy or with the ex-head of the State Fiscal Service of Ukraine Roman Nasirov".
What makes Mossada so special? This Cypriot offshore company does not have an accidental history. Mossada, as it is seen in open registries, evolved from the Cypriot Frugifera Investments, in which Alona Degrik was also a director. It is the connection of the directors that leads us to another branch of assets through LLC Bilosnizhka2013 (38545665), which was headed by Alyona Degrik in 2013–2014. Panamanian Bewley Trade Inc. was a 100% participant in Bilosnizhka.
Bewley Trade had business connections (common registration addresses, nominee directors, etc.) with the owners of corporate shares in the Tyme payment system, which was deprived of the NBU license due to the transfer of funds through Russian payment systems prohibited in Ukraine. For example, Tyme used the Russian PS Contact to make payments in the Russian Federation through residents in Kuwait, so it was possible for a long time, by splitting payments, to bypass Ukrainian sanctions against Russian payment system operators.
It should be reminded, Alyona Shevtsova is also suing Mind over the editorial investigation of illegal online casinos in Ukraine.
After the release of the investigation, the edition, the author of the material, and the editor-in-chief became the target of dirty information attacks and threats.
