Captives from Azovstal may be illegally tried by russia

On May 26, the Supreme Court of russia will consider the case of recognizing the Ukrainian battalion Azov as a terrorist organization.

This was reported on the website of the Ministry of Justice of the russian federation, which was the initiator of the lawsuit, writes The Insider.

That happened immediately after the Azov fighters were evacuated to the russian-occupied territory.

Lawyer Ivan Pavlov believes that this is done in order to bring the prisoners to court, although it is illegal, and he explained why.

“From a juridical point of view, the persecution of these people for participating in Azov will be illegal. The consequences of participation in a terrorist organization can occur only with the comming into force of the decision to recognize the organization a terroristic one. The court's decision to consider Azov a terrorist organization will appear and come into force after a number of fighters of this battalion were taken prisoner. Based on the legal principle of prohibiting the retroactive effect of the law, this decision cannot retrospectively affect the activities of captured citizens,” Pavlov said.

Meanwhile, the State Duma demands the return of the death penalty after the evacuation of Azovstal fighters to the occupied territories.
