What happened? The Cabinet of Ministers of Ukraine allowed unscheduled business inspections on the basis of “separate decisions of central executive authorities”.

Details. “In the presence of a threat that has a negative impact on the rights, legitimate interests, human life and health, protection of the environment and ensuring the security of the state, as well as to fulfil Ukraine's international obligations during the period of martial law, to allow unscheduled measures of state supervision (control) on the basis of decisions of the central executive authorities that ensure the formation of state policy in the relevant areas,” the document states. The Government amended its Resolution No. 303 of March 13, 2022 “On the termination of state supervision (control) and state market supervision under martial law”.

The European Business Association has already reacted to the news: “We hope that this decision will not be used by regulatory authorities as an instrument of pressure on transparent business, but will make it possible to identify overuses or violations among unscrupulous individuals.”

At the beginning of the war, the government suspended unscheduled and even scheduled inspections. Already in June, government officials allowed unscheduled inspections “in certain areas”, in particular to “prevent uncontrolled growth of prices for goods of significant social importance”. The basis for such inspections is the decision of the central executive body in the relevant area.
