The rules for registering business in Ukraine change today
The relevant order of the Ministry of Justice approving new application forms has entered into force
On 1 May, an order of the Ministry of Justice came into force approving new application forms for state registration of legal entities, individual entrepreneurs, and public associations.
This was reported by the Notary Chamber of Ukraine.
This refers to the Order of the Ministry of Justice of Ukraine dated 29 March 2023 No. 1158/5 on amendments to certain regulatory legal acts of the ministry of justice of Ukraine. Application forms in Excel and PDF can be downloaded on the website of the Ministry of Justice.
The amendments were also made to the Requirements for spelling the name of a legal entity, its separate subdivision, public formation that does not have the status of a legal entity, except for a trade union organisation:
- to write the name of a legal entity, the letters of the Latin alphabet are used when writing the name not only in English, but also in any foreign language;
- the name of a separate subdivision instead of the words "separate subdivision" ("branch", "representative office") should contain only the concept "branch" or "representative office".
In addition, amendments were made to the Procedure for state registration of legal entities, individual entrepreneurs and public associations that do not have the status of a legal entity.
In particular, when submitting an application in electronic form, if the law provides for the submission of a copy of an identity document and proof of citizenship of a person who is the ultimate beneficial owner of a legal entity for state registration, electronic copies of such documents made by scanning with a qualified electronic signature of the applicant shall be attached to the application.
